Last week, as part of its “Standard Improvement Project” rulemaking announcement, OSHA proposed to fundamentally alter the scope and application of the lockout/tagout standard by deleting the term “unexpected” from the standard entirely. This change will fundamentally broaden the scope of the standard.
Since OSHA issued its final rule in May 2016, employers have questioned how it will impact their current policies and what they will have to do to comply. OSHA will begin enforcing the anti-retaliation provisions of its new rule on November 1. Leech Tishman OSHA Partner Dan Flynn will conduct an informative CLE on this topic.
