Court Highlights Role of Leech Tishman IP Lawyer in Recent Technology Case

Jeff Sheldon Recognized for Expert Testimony in Medical Technology IP Case

LOS ANGELES, CAA statement of decision by a Superior Court Judge in California singled out Leech Tishman attorney Jeff Sheldon for his expertise and thoroughness in defending an inventor’s ownership in his patents.

Sheldon, who chairs the firm’s Intellectual Property Practice Group, testified at trial as an expert, that an inventor had no obligation to assign rights in new medical technology because of an earlier assignment.

Mr. Sheldon went “toe to toe” with an opposing legal expert. But the court accepted and relied upon Mr. Sheldon’s analysis and that of a technical expert, who were praised as:

“… more persuasive based on their training and experience, the facts they relied on, and the reasons for their opinions. The background and experience of both … experts … were more extensive and closely focused on the subject-matter of the issues of this case. … [Sheldon and the technical expert] testified based on a review of the entire patents. … the prosecution histories, and the patent applications in their entirely including the specification background, claims, the drawings, fields involved, the summary of the inventions, the best practices, and best mode. In fact they went even further by reviewing the prototypes, embodiments and the mockups.  [They] were also more confident and specific in their testimony.”

The court also noted:

“ . . .the demeanor of the witnesses, the confidence, the quickness with which they answered, those types of things, I think favored both defense witnesses.”

Sheldon, who holds a Master of Science in Biomedical Engineering from the University of Strathclyde and a B.S. in Chemical Engineering from Carnegie Mellon University, has been recognized by California Lawyer as one of the 20 best intellectual property lawyers in the state.
