In Brief

From general compliance counseling to enforcement defense, our OSHA attorneys have a deep knowledge of federal and state occupational safety and health standards and regulations, from recordkeeping to general industry to construction. The attorneys at Leech Tishman are well-versed in the OSH Act  and OSHA’s standards, and work with clients in various industries to create solutions to comply with OSHA’s standards. We routinely help clients manage inspections, especially those resulting from workplace accidents, and evaluate settlement options during the information conference period. 

The OSH Act pertains to owners, contractors, employers, supervisors and workers, and certain parties could face charges and penalties if there is failure to comply. Often, it is in the company’s best interest, however, to contest citations. We regularly represent our clients throughout the litigation process before the Occupational Safety and Health Review Commission or equivalent state judicial body.

Within the complex current labor climate, our attorneys have significant experience in responding to the wide-ranging matters arising under OSHA complaints and inspections resulting from union involvement.  We frequently counsel our clients on tactics often used by unions attempting to gain bargaining power, or in the instance where OSHA tries to expand the scope of union involvement.  We have successfully responded to OSHA complaints and inspections resulting from union complaints in the commercial printing, commercial laundering, heavy equipment manufacturing, power distribution, and airline industries.

In addition to overseeing inspections and defense of OSHA citations, we can respond immediately to workplace catastrophes that often lead to fatalities, multiple injuries, and evacuations. Our attorneys appreciate the delicacy involved in handling fatalities and serious injuries and can effectively balance it with the appropriate response to the regulatory investigations that inevitably follow a workplace catastrophe.  We have successfully defended numerous fatality citations.
