Back to Business: Proof of Vaccination and Weekly COVID-19 Testing: OSHA’s Impending Emergency Temporary Standard: Updates, Legal Challenges & Ongoing Employer Preparation

The Occupational Safety and Health Administration (OSHA) has been working expeditiously on an emergency temporary standard (ETS) on COVID-19 vaccination and testing. On Monday, October 11, The Department of Labor took the next step in advancing President Biden’s vaccine mandate-or-test emergency rule, sending the ETS to the White House’s regulatory office. An announcement on the final ETS is expected within the next couple of weeks.
While employers wait for more information on the final ETS, the Leech Tishman Employment & Labor Group has been keeping a close eye on legal developments and challenges.
