Leech Tishman Employment & Labor National Chair Philip A. Toomey to Participate in PELRAC’s 2020 Virtual Annual Training Conference
October 29 @ 2:00 pm - 3:20 pm
Phil’s session, entitled “The Evolving Collision of the Drug Free Workplace, Drug Testing and Cannabis and Other Recreational Drugs” will take place on October 29, 2020 from 2:00pm to 3:20 p.m.
As the use cannabis and other recreational drugs become acceptable and commonplace, and can sometime part of a medical treatment or pain management plan, employers with Drug Free Workplace Policies are faced with some very difficult choices. Human Resource professionals can be challenged to correctly determine when enforcement is appropriate, legal limitations on any enforcement, and how the duty to accommodate may be impacted by such policies. In this session participants will be brought current on the law of “off-campus” recreational and medical drug use, the science behind testing (including synthetic THC), and how to rationally apply a Drug Free Workplace Policy, especially for safety sensitive positions, in an evolving workplace.
