On October 15, 2019, Leech Tishman Employment Partner, Eric J. Wu and Employment Counsel, Fadi K. Rasheed will discuss California’s complicated laws concerning independent contractors. Leech Tishman Intellectual Property Partner W. Thomas Babbitt will also discuss considerations for intellectual property rights with independent contractors.
We will discuss the risks of misclassifying employees, including wage and hour liability and other legal considerations. We will also help employers understand how misclassification can affect their business while providing guidance on how to correctly classify workers as independent contractors.
The forum will also include discussion on the changes in the law in the wake of the “Dynamex decision,” the “ABC” Test, and California AB 5, which just recently passed through the California State Senate and includes exemptions for workers from certain industries.

About the Forum
On April 30, 2018, the California Supreme Court in Dynamex Operations West, Inc. v. Super. Ct. (2018) 4 Cal. 5th 903, adopted the “ABC” Test when evaluating whether a worker is an employee or independent contractor. We will talk about the “ABC” Test and how to use it to determine if a worker can be classified as an independent contractor.
We will also analyze California AB 5, which virtually codifies the “ABC” Test, and includes exemptions for many workers, including licensed insurance agents, certain licensed health care professionals, registered securities broker-dealers or investment advisers, direct sales salespersons, real estate licensees, commercial fishermen, and workers providing licensed barber or cosmetology services.
