About Proposition 65
The Safe Drinking Water and Toxic Enforcement Act of 1986, also known as Proposition 65 or simply “Prop 65,” was intended to protect California citizens from chemicals known to cause cancer, birth defects or other reproductive harm. It requires companies to inform California citizens about exposures to such chemicals in the form of labels.
If a company is alleged to have not provided adequate labels, they may receive a “60 Day Notice” letter of the alleged violation. This letter officially starts the 60-day window for the company to contact the plaintiff and attempt to resolve the issue.
Penalties for violating Prop 65 can be as high as $2,500 per violation per day. Proposition 65 affects any business that sells consumer goods into California, even if the company is headquartered elsewhere.
