Anti-Kickback Statute Enforcement: Lessons from the $202 Million Gilead Speaker Program Settlement

March 18, 2026

By: Laurel F. Grass, Esq. and Harry J. Nelson, Esq.

A recent $202 million settlement involving Gilead Sciences serves as another reminder that physician speaker programs remain a continuing focus of federal healthcare enforcement. While speaker programs can play an important role in disseminating clinical information, regulators have increasingly scrutinized whether such programs function as legitimate educational activities or instead operate as marketing mechanisms that provide financial value to prescribers.

The Gilead case (The United States of America, et al. ex rel. Dr. Paul Bellman v. Gilead Sciences Inc.) illustrates a broader enforcement theme: arrangements that provide benefits to physicians—even when structured as educational or consulting activities—can create significant regulatory risk if regulators conclude that the underlying purpose is to influence prescribing behavior tied to federally reimbursed healthcare services.

For healthcare companies operating in heavily regulated markets, the settlement underscores the importance of carefully structuring physician engagement activities to ensure that they remain commercially reasonable, appropriately documented, and clearly tied to legitimate business purposes.

Overview of the Government’s Allegations

Gilead, a pharmaceutical manufacturer best known for its antiviral medications, including therapies for HIV/AIDS, operated physician speaker programs between January 2011 and November 2017 as part of its marketing strategy. According to the government, these programs often involved expensive meals, travel to desirable locations, and repeated attendance by the same healthcare providers, raising concerns that the programs served primarily as incentives to prescribe Gilead’s products rather than as bona fide educational programs.

Federal prosecutors alleged that these benefits constituted improper remuneration intended to induce physicians to prescribe the company’s drugs, in violation of the Anti-Kickback Statute (AKS). Speaker programs themselves are not inherently problematic and remain widely used throughout the pharmaceutical and medical device industries. However, enforcement authorities have increasingly focused on whether such programs involve legitimate educational content or instead provide financial benefits that could influence prescribing decisions.

The Anti-Kickback Statute

The Anti-Kickback Statute (42 U.S.C. §1320a-7b(b)) is a federal criminal law that prohibits knowingly and willfully offering, paying, soliciting, or receiving anything of value in exchange for referrals of items or services reimbursable by federal healthcare programs. The statute is intentionally broad. “Remuneration” can include not only direct payments but also meals, travel, consulting fees, honoraria, entertainment, or other benefits provided to potential referral sources. Violations can result in criminal penalties, civil monetary penalties, and exclusion from federal healthcare programs.

In practice, however, many AKS enforcement matters arise in the civil context through False Claims Act litigation, where alleged kickback arrangements are tied to claims submitted to federal healthcare programs.

The AKS–False Claims Act Connection

The Gilead settlement also illustrates the powerful relationship between the Anti-Kickback Statute and the False Claims Act (FCA). Under the Affordable Care Act, claims submitted to federal healthcare programs that result from an AKS violation are deemed false claims for purposes of the FCA. As a result, alleged kickback conduct can trigger significant financial exposure, including treble damages and substantial per-claim penalties.

Many of the largest healthcare enforcement actions in recent years have relied on this statutory linkage between the AKS and the FCA. The Gilead matter began as a qui tam whistleblower action filed under the False Claims Act before federal prosecutors intervened, reflecting the continuing role of whistleblower litigation in driving large healthcare enforcement cases. Courts are also continuing to address how directly an alleged kickback must be tied to a specific claim for reimbursement. Recent appellate decisions, including United States v. Regeneron Pharmaceuticals, Inc., 128 F.4th 324 (1st Cir. 2025), have examined whether the government must prove “but-for” causation between the alleged kickback and a resulting claim submitted to a federal program. The issue remains the subject of ongoing debate among federal courts.

Enforcement Trends in Physician Marketing Programs

The Gilead settlement reflects a broader enforcement pattern involving physician marketing and engagement programs across the healthcare industry.

Regulators have increasingly focused on several recurring issues, including repeated attendance by the same physicians at speaker events, programs held at high-end restaurants or travel destinations, speaker honoraria paid to physicians who rarely present new material, events with limited substantive educational content, and hospitality or entertainment components that appear disproportionate to the educational purpose of the program. These factors often lead regulators to question whether a program was designed primarily to reward prescribing behavior rather than to educate clinicians. For pharmaceutical and medical device companies, the enforcement environment makes clear that physician marketing activities must be structured with careful attention to both compliance controls and operational documentation.

Practical Compliance Lessons

The Gilead settlement reinforces several practical lessons for healthcare companies and organizations engaging physicians in marketing, consulting, or educational activities:

  1. Speaker programs should have a clear and documented educational purpose. Programs with repetitive audiences or limited new clinical information can create regulatory risk.
  2. Hospitality associated with educational events should remain reasonable and clearly tied to the educational objectives of the program. High-end venues or entertainment components frequently become focal points in enforcement investigations.
  3. Speaker compensation and consulting arrangements should be supported by documented fair market value analyses. Payments to physicians should correspond to legitimate services actually performed.
  4. Organizations should implement ongoing monitoring of physician engagement activities, including attendance patterns, speaker utilization, and program content.
  5. Companies should ensure that compliance oversight is integrated into the design of physician engagement programs rather than applied only after programs are implemented.

Organizations that treat physician marketing programs primarily as commercial initiatives without incorporating structured compliance review face increased regulatory risk.

Key Takeaway

The Gilead settlement serves as another reminder that the Anti-Kickback Statute remains one of the government’s most powerful enforcement tools in the healthcare sector.

Even common industry practices—such as speaker programs, consulting agreements, and educational events—can create substantial liability if regulators conclude that they function as inducements tied to federally reimbursed healthcare services. Healthcare organizations should periodically review physician engagement activities to ensure that program design, compensation structures, and documentation practices remain aligned with evolving enforcement expectations. Proactive compliance oversight can significantly reduce the risk of the type of large-scale FCA exposure illustrated by this case.
