Intellectual Property Partner Allen B. Grodsky was recently featured in Law360, Courthouse News Service, and the Daily Journal for his representation of Kat Von D in the ongoing copyright case Sedlik v. Von Drachenberg.
The latest coverage follows oral arguments before an en banc panel of the U.S. Court of Appeals for the Ninth Circuit, which is considering whether to modify its longstanding framework for determining substantial similarity in copyright infringement cases. The Ninth Circuit previously affirmed the jury verdict in favor of Von D before granting rehearing en banc and vacating that panel opinion.
During the en banc hearing, Grodsky urged the court to retain its existing substantial similarity framework, arguing that disagreement with the jury’s verdict does not justify abandoning the longstanding test. Grodsky also addressed how any potential change in the Ninth Circuit’s standard should apply to Von D’s case, which was tried under the existing framework.
