Esteban J. Elias, Partner and head of the Latin America Practice Group, was recently featured in a Bloomberg Línea article titled, “Five Regulatory Trends That Would Impact Airbnb-Type Short-Term Rentals in Latin America” by Daniel Salazar Castellanos. The article examines how governments across the region are responding to the growth of short-term rental platforms through increased regulation and oversight.
In the article, Elias comments on the regulatory situation in Chile and Peru. He explains that Chile’s approach does not rely on a single tourist registration system but instead uses two main tools: co-ownership rules that may limit use in buildings, and tax compliance requirements. Elias also notes, “Peru is entering the market through fiscal and formalization measures: rather than prohibiting, the State seeks traceability and incorporation into the tax system, and Congress has discussed digital registration schemes for tourist rentals.”
