U.S. Supreme Court Rules That Title VII Prohibits Employment Discrimination On Basis of Sexual Orientation
By: Philip A. Toomey, Esq.
The U.S. Supreme Court just ruled that Title VII prohibits employment discrimination on the basis of sexual orientation.
In a 6-3 decision announced this morning, the U.S. Supreme Court ruled federal law protects gay and transgender workers from job discrimination (Bostock v. Clayton). The Court’s decision applied the longstanding federal ban on sex discrimination in the workplace to cover bias on the basis of sexual orientation and gender identity where state anti-discrimination laws do not cover sexual orientation and gender identity. More than half of the states do not have such coverage.
