McGuigan represents companies across the U.S. in employment matters, with a particular emphasis on California. Kate combines her litigation defense experience with her counseling expertise to provide practical and focused representation for clients across a range of industries, including healthcare, transportation, manufacturing, construction, and technology.
Kate regularly appears on behalf of employers in state and federal trial and appellate courts, as well as before administrative agencies. She has extensive experience managing complex wage and hour litigation, including misclassification disputes involving independent contractor and exemption issues. Kate has successfully obtained summary judgment in several employment matters, resolved class claims through arbitration, and successfully overturned a multimillion-dollar employment verdict on appeal. She has also mediated hundreds of labor and employment disputes.
Kate advises on workplace compliance and risk management, internal investigations and crisis management strategies, wage and hour compliance, employee transition and noncompete issues, reductions in force, executive compensation, and the separation of individual employees.
