Our attorneys represent both complainants and respondents before in IP cases before the ITC, alleging infringement under Section 337 of the Tariff Act of 1930. We understand the distinctions and intricacies of these types of investigations, including the expedited schedule and the nuanced rules and procedures when appearing before the ITC.
Several of our attorneys have appeared as lead counsel in ITC cases and are familiar with the unique briefing process in Section 337 cases, and have also previously appeared before an Administrative Law Judge (ALJ). Our litigators also possess a depth of experience in this type of litigation, including pre-trial hearings, discovery, taking depositions, working with expert witnesses, and taking or defending against witness testimony.
Following the ITC’s ruling, we work directly with clients to provide support following the issue of exclusion orders from the ITC. Leech Tishman’s attorneys have also worked with plaintiffs who, while the ITC case is pending, concurrently file allegations of patent infringement in federal courts. Our IP lawyers work with clients to obtain additional patent protection in federal courts following the decision of the ITC.
